Country roads, take me home….or maybe away from home, if you’re one of the thousands of couples who are choosing to do something different from the traditional wedding and eloping instead. If stunning views are your thing (and why wouldn’t they be?), the New River Gorge has lovely rivers which you can view from several overlooks. Or if you’d like stunning photographs from your special day, hiking in Dolly Sods offers up views of colorful meadows, complete with striking peat moss that makes for awesome visuals and really makes the white of a wedding dress stand out.

The colorful foliage means that fall is a great time to marry in West Virginia, and the weather shouldn’t be too cold either. Outdoor weddings can also take place in late spring / early summer when it isn’t too hot. For winter weddings, you can expect gorgeous crisp snow however temperatures will be low!

GETTING YOUR MARRIAGE LICENSE

All states require a marriage license, so you need to ensure that you understand all of the requirements very early in the planning process. Luckily, it’s fairly straightforward in most cases as long as you meet the criteria and follow the state requirements.

Here is what you need to know about getting a marriage license in West Virginia.

Is Same Sex Marriage Recognized?

Yes! Same sex marriage is recognized in all states, and at a federal level, under the Respect for Marriage Act which was signed into law in December 2022.

Will I Need to take a blood test?

No. Blood tests have been abolished as part of marriage license applications in all 50 states, so don’t worry if you’re afraid of needles!

Who Issues Marriage Licenses in West Virginia?

Marriage licenses in West Virginia are issued by the County Clerk’s office.

Do I Need to be a Resident of West Virginia?

Both residents and non-residents may apply for a marriage license in West Virginia. Residents should apply in the county where one or both of you live, while non-residents may apply anywhere in the state.

Is there a waiting period to get married?

There is no waiting period to marry in West Virginia once a marriage license has been issued, apart from minors under the age of 18 who are subject to a 3 day waiting period.

How long will my marriage license be valid for?

Marriage licenses issued in West Virginia expire 60 days after the date of issuance.

HOW OLD DO I NEED TO BE TO GET MARRIED IN West Virginia?

To marry with no caveats in West Virginia, couples must be 18 or older. Those aged 16 or 17 may apply for a marriage license with parental consent, and those under 16 must have both parental and judicial consent.

WILL I NEED TO TAKE ID?

You will need to take ID with you to your appointment. A driver’s license or certified copy of your birth certificate is advised.

HOW MUCH DOES A MARRIAGE LICENSE COST IN West Virginia?

There is a fee of $57 for marriage licenses issued in West Virginia. This fee can be reduced to $37 if the couple completes a premarital counseling course.

There is no requirement to have witnesses to the marriage in West Virginia.

DOES West Virginia REQUIRE AN OFFICIANT FOR A WEDDING?

An officiant is required to solemnize marriages in West Virginia. Judges may perform marriage ceremonies, as well as ministers. Ministers must be licensed and registered with the state.

Those ordained by online ministries may officiate your wedding, but they will still need to register with the state. This process involves submitting hard copies of your ministry credentials, so plan ahead of time if you need to get these ordered.
